Judge William Sullivan, who is presiding over the ongoing Lindsay Clancy murder trial, told the Massachusetts courtroom on Wednesday evening that he will allow jurors to consider the charge of manslaughter once they begin deliberations.
Judge Sullivan stressed before closing arguments set to begin Thursday that should the jury find that the prosecution has not met the burden of proof for murder in the first degree, they will be able to find Clancy guilty of manslaughter. Clancy, a 32-year-old former labor and delivery nurse, is on trial for strangling her three young children – 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan – with rubber exercise bands.

Nobody denies that Clancy killed her children. The prosecution states that she “acted intentionally, rationally and swiftly” rather than in a moment of postpartum psychosis; she very deliberately planned the murders by researching them ahead of time and ensured her husband was out of the house. The defense insists that the killings were triggered by a lethal combination of psychiatric medications and her postpartum struggles.
