() — The Lindsay Clancy murder trial stumbled toward a mistrial declaration today as defense attorney Kevin Reddington asked for an opportunity to file an appeal allowing him to argue that the jury should not be dismissed and the holdout juror be replaced so that the proceedings can continue without a dismissal.
Reddington asked Judge William Sullivan for a day to make his appeal. Sullivan gave him just 60 minutes.
Court observers expressed shock at Reddington’s move, calling it a desperate “Hail Mary pass” attempt. Legal expert Jonathan Turley said, “This is perfectly bonkers.”
“If I was the judge, I would say, ‘Let me get this straight: you objected to my not swapping out the alternate and you’re waiting now to go and file something like this? You’re just a bit late on that, pal, and I’m going to go ahead and declare a mistrial!’”
“This case is dead as Dillinger,” declared Turley, commenting during Fox News’ live coverage of the trial.
Famed defense attorney Allan Dershowitz offered a different interpretation of Reddington’s actions. Dershowitz said that Reddington was playing the long game, laying a foundation for precluding a retrial on the basis of protecting his client from double jeopardy.
When the court reconvened after the hour was up, Judge Sullivan announced that the appellate court judge had denied the relief sought by Reddington. As anticipated, Sullivan announced the jury was deadlocked and declared a mistrial.
The mistrial declaration stems from one male juror’s refusal to accept that there was reasonable doubt of Lindsay Clancy’s guilt regarding the murder of her three young children.
Conservatives on social media began hailing the male juror as a hero even before the judge’s final declaration of a mistrial.
“A single LONE MAN held out against the many to not let her off,” Matt Van Swol said on X.
“GOD BLESS THAT MAN!!!!!!” he declared.

“One heroic male juror held the line for six days. This should have been a guilty verdict, but at least he prevented the atrocity of an acquittal,” The Daily Wire host Matt Walsh said. “Now it’s up to the DA to do the right thing and prosecute the case again.”
On Friday morning, as the trial reconvened on the seventh day of jury deliberations, Judge Sullivan heard arguments from the prosecution and the defense regarding the single holdout juror, who, according to a note sent by the jury foreperson yesterday, “refuses to listen to the law … on reasonable doubt.”
Before the day began, Reddington filed a motion asking that “there be no further sidebars and this trial and all related proceedings will be handled in open court.”
It became abundantly evident that Reddington believed the jury was split 11-1 in favor of his client. His statements to the court show that he wanted the holdout juror removed from the case.
Over defendant attorney Reddington’s objection, Judge Sullivan said he would not conduct a further inquiry of the juror causing the impasse and would send the jury back to deliberate. He stated that he would direct the jury panel to “follow the law as I give it to you, whether you agree with it or not.”
At 9:30 a.m. Sullivan called the jury into his courtroom, and after giving a few instructions, sent them back to deliberate. Two hours later, they returned and told the judge they remained deadlocked.
